In compliance with the regulations of the Bangko Sentral ng Pilipinas (BSP) and the requirements of the Anti-Money Laundering Act (AMLA), all Users of Rhemit are required to undergo a mandatory Know-Your-Customer (KYC) verification process. These limits are determined based on the User’s verification level, transaction history, risk assessment, and compliance with the standards prescribed by the Bangko Sentral ng Pilipinas (BSP) and other applicable laws. Transaction limits may vary among Users and may be adjusted at any time based on regulatory directives, operational considerations, or the Company’s assessment of potential risks.

The following categories of limits may apply to the User’s Account:

    • Daily and monthly remittance limits, which govern the maximum amount a User may send within specified periods.
    • Wallet balance limits, which control the maximum allowable amount that may be stored in the User’s Rhemit account at any given time.
    • Deposit and withdrawal limits, which restrict the size and frequency of cash-in and cash-out transactions through approved channels.
    • Currency exchange limits, which regulate the volume of currency conversions a User may perform, subject to foreign exchange rules and risk controls.

Rhemit reserves the right, at its sole discretion, to modify, reduce, suspend, or reinstate transaction limits at any time and without prior notice, particularly when required by regulatory mandates, fraud prevention measures, system issues, or ongoing reviews of User activity. Users acknowledge that exceeding these limits may result in declined transactions or temporary account restrictions.

  7. REMITTANCE TO THIRD-PARTY RECEIVERS

Rhemit enables Users to send funds to individuals who may not be registered Rhemit Users, through authorized partners, payout centers, banks, e-wallets, or other accredited channels. This feature allows Senders to transfer money to beneficiaries who will claim the funds externally, subject to compliance with partner requirements, applicable laws, and operational guidelines. By using this service, the Sender acknowledges and accepts that Rhemit relies on third-party partners for processing, releasing, and verifying payouts, and that the accuracy of the information provided by the Sender is critical to the successful completion of the transaction.

      2. Ensure Lawful and Legitimate Use
Confirm that the transaction is lawful, does not violate any applicable Philippine or foreign laws, and is not related to fraud, money laundering, terrorist financing, or any prohibited or suspicious activities under the AMLA and its implementing rules.

      3. Verify Payout Options and Requirements
Review and understand the availability, requirements, processing times, fees, foreign exchange rates, claim procedures, identification requirements, and restrictions applicable to the selected payout method and payout partner prior to confirming the transaction.

      4. Cooperate in Compliance/KYC Processes

The Sender acknowledges that any error, inaccuracy, omission, or fraudulent information supplied by the Sender may result in delays, failed payouts, unclaimed funds, reversals, regulatory holds, or cancellation of the transaction. Rhemit shall not be liable for any loss, damage, cost, or inconvenience arising from such Sender-supplied errors or from the Sender’s failure to comply with the above obligations.

The Sender further agrees to indemnify and hold Rhemit, its officers, directors, employees, and partners free and harmless from any liability, claim, penalty, loss, or expense arising out of or related to (a) incorrect or misleading information provided by the Sender, (b) unlawful or suspicious transactions, or (c) breach of any of the Sender’s responsibilities under this Agreement.

Events outside Rhemit’s reasonable control, including natural disasters, strikes, wars, pandemics, system failures, or government actions.

Rhemit does not guarantee the timing, availability, or receipt of funds once a transaction has been initiated, as final settlement is subject to payout partner procedures and external systems.

The Sender and Receiver agree to indemnify, defend, and hold Rhemit, its affiliates, officers, employees, and partners harmless from any claims, liabilities, losses, or expenses arising from:

      (a) the Sender’s failure to provide accurate information;

      (b) the Receiver’s failure to comply with claim procedures; or

      (c) delays, reversals, or cancellations arising from fraud prevention, compliance reviews, or risk management actions.

Any funds unclaimed after the payout partner’s retention period may be returned to the Sender or otherwise handled according to Rhemit’s policies and applicable laws and regulations.

Unless required by law or expressly stated by Rhemit, fees paid or charged in connection with a transaction are final and non-refundable, even if the Receiver fails to claim the funds or if the transaction is delayed or cancelled due to Sender error, incomplete information, compliance review, or force majeure events. When permitted or required, third-party or payout partner fees may be deducted from the remitted amount prior to release to the Receiver.

The Sender shall remain fully liable for any chargebacks, reversals, disputes, or retrieval requests initiated by banks, issuers, or payment processors. Rhemit may recover such amounts, including related fees and administrative costs, by deducting them from the Sender’s account balance or future transactions.

  9. CURRENCY EXCHANGE TERMS
    • Variable Exchange Rates
The actual exchange rate applied to a transaction is based on the prevailing real-time market rate plus Rhemit’s operational margin, service spread, or partner-imposed FX margin. Exchange rates displayed are indicative and may change without prior notice until the transaction is confirmed and processed.
    • FX Rate Fluctuations and Market Conditions
Exchange rates are subject to global market conditions, liquidity factors, and third-party pricing. Rhemit shall not be liable for any loss, shortfall, or perceived disadvantage caused by exchange rate fluctuations, delays in processing, or any difference between indicative and executed rates.
    • No Refunds After FX Conversion
Once a transaction involving currency conversion has been completed, FX conversions are final and non-reversible.
Refunds, reversals, or chargebacks cannot be made based on:
      • dissatisfaction with the applied exchange rate,
      • subsequent changes in market rates,
      • the Receiver’s failure to claim funds, or
      • delays caused by third parties or compliance checks.
      • Additional Verification and Compliance
Foreign exchange transactions may require additional documents, identity verification, or information as part of AML/CTF compliance or risk monitoring. Rhemit may delay, hold, suspend, or cancel any FX-related transaction pending completion of verification, and shall not be liable for delays or rate changes that occur during such review.
      • Third-Party and Partner FX Rules
Payout partners, banks, or correspondent institutions may apply their own FX rules, margins, restrictions, or processing timelines. Rhemit is not responsible for any differences between its own indicative rates and those applied by third-party partners.
      • Rate Application
The rate applicable to the transaction shall be the rate at the time the transaction is executed by Rhemit’s system or payout partner. Rhemit makes no guarantee that the rate shown at the time of review or initiation will be the final rate applied.
      • Disputes Related to FX
The Sender acknowledges that FX pricing involves variable market components. Thus, Rhemit shall not accept disputes, claims, or chargebacks related to FX rates, margins, or timing of application, except as required by law.
